Ebayer selling DVDShrink, DVDDecrypter amp; Nero 6 Demo

Item listed here

Have you bought yourself a DVD Burner yet? If you have, you may have tried to backup your DVDs unsuccesfully... If so, this is why;

Most DVD movies are DVD-9 which means it's dual layer, and unless you have a dual layer burner and can afford dual layer media, then you will need to quot;Shrinkquot; it down to DVD-5 which is single layer, which most DVD +/- R are.

What you will be purchacing from me is a CD containing a FREE program that will decrypt, compress and burn* onto a DVD-5 DVD R plus a FREE copy of DVDDecrypter, and a DEMO version of Nero 6.

The quality is unbelievable for the amount it compresses, take a massive movie like Lord Of The Rings, squash it down to 4.7GB, and I would bet that only 9 out of 10 people could notice the difference.

* This program relies on other programs to burn the DVD, if you have DVDDecrypter, Nero Burning ROM 6 or CopyToDVD, then this program will automatically initialise these programs to burn your backup movie!!! VERY SIMPLE

It is possible that this program wont work on some burners, I recommend the Pioneer DVR-107 or 108.

It is illegal to sell Shareware, Freeware and Demo Software for profit.
I am not selling this software for profit, my price includes;
- My Download Costs
- The CD and CD Jewel Case
- My costs of burning the CD
- The cost of postage and packaging

It is up to the end user to comply with the license agreements with the software companies. The software on this CD is shareware and free for all to use, providing they comply with the licence agreement.

Please note: Backups of movies are not backups if you don't own the original! If you don't own the original, then this is an illegal bootleg/burnt copy.

Please do not ask me about any of the features of the above software, appropriate instructions will be provided when you purchace the CD.

I am not selling this software to you, I am giving it to you for FREE, what you are purchacing is the CD and CD Jewel case from me.

Thoughts anyone ?

sounds like a crock of poo.

hmm... guy's from my town, too.

any ebayers here, should put comments on this item with a link to 's guides.

what this guy's doing is legal, but very stupid.  i don't think he's going to be sucking anyone in (and if he does, maybe they get what they deserve?).

I guess it's perfectly legal ... if people buy it, so what? He openly states what he is charging for, he clearly says that this is freeware and demo software only (he might need a permission from Ahead for distributing the Nero demo, but that's about it).

However ... this guy's grasp of his native (?) tongue is severely lacking ... I somehow like this one the best: take a massive movie like Lord Of The Rings, squash it down to 4.7GB, and I would bet that only 9 out of 10 people could notice the difference.

LOL ... I guess this offer is for the remaining 10%, then.

Steve

Yeah, sure. Just like when you buy Windows, you're only buying the CD and case it comes on/in. The fact that it's got Windows on the disc is just a bonus.

Regardless of how this is worded, it is utter rubbish IMO to claim that he is not profiting from the software contained on the discs.

Technically the guy would be liable for DMCA violations. To begin with. Then again aren't we all. Just that the rest of us are not so easily traceable. The quality is unbelievable for the amount it compresses, take a massive movie like Lord Of The Rings, squash it down to 4.7GB, and I would bet that only 9 out of 10 people could notice the difference.

Only 9 out of 10 people notice the differnece? Why that's not bad at all. or is it? I think his statistics are skewed in weird ways. 9 out of 10 people can hardly tell the differnce between my backup and the original. Becuase after cutting off previews, subs, and alternate languages you hardly have to recompress much.It is illegal to sell Shareware, Freeware and Demo Software for profit.

No it isn't. You just have to meet certain criteriaI am not selling this software for profit, my price includes;
- My Download Costs

And how exactly does one quantify that? And futher WTF?! Does he redownload the files each and every time he burns a CD? Why even mention downloading costs? It is clear from that alone he is likely deriving some sort of profit.- The CD and CD Jewel CaseThat is possible and easy to document. I have done similar for friends and aquantances.- My costs of burning the CD

Again the only clear cost is time. And if his time is worth money that is profit is it not?- The cost of postage and packaging

That is doable. It is up to the end user to comply with the license agreements with the software companies.

Wrong-o. Distributors bear some responsibility as well. The authors et all may request that someone not host their files.I am not selling this software to you, I am giving it to you for FREE, what you are purchacing is the CD and CD Jewel case from me.

Then the question is why waste time and effort. Just point them to the public download sites and let them download for themselves. To do otherwise would imply that there is something in it for him. If a person is savvy enough to download and use the programs they are savvy enough to have a dl manager. I have donloaded much much more over dialup over bad lines.

this is hardly anything new. 321studios sold a guide and bundled freeware for $49:95(thats u.s. dollars) for years making millions. what a pity that are gone huh ?

Technically the guy would be liable for DMCA violations. To begin with

the guy's from my town.  australia's spin on the DMCA starts on new year's day (and it's not retrospective), so i guess this guy's in the clear on that front.

australia's spin on the DMCA starts on new year's day

yes and to get it signed they gave away more copyright concessions, which they are not giving  hell of a lot of detail about yet.hmm... this page hasn't been updated since june 3.

trade/negotia...ext/index.html

maybe we should keep an eye on this page to see what changes are made. (we're looking at chapter 17 here)

well if you believe Mark Vaile only minor language changes were made and its still basically what they negotiated.
tran...1118_apec.html

have a look at the copyright amendments and see how quot;littlequot; was amended.

The seller of these items has since taken this item and one other that contained items such as Windows Service Packs, Adobe acrobat reader, etc etc, down, and has emailed me. I think it's only fair to share the contents of those emails:

You asked:
quot;Regardless of how you justify this, you are committing an illegal act and are violating the EULA by selling these softwares. It's a pity I'm a member of as well as (both well-known for housing the creators of both DVDShrink and DVDDecrypter), and I have created threads regarding your selling of their creative works. I expect you will hear from them in due time. Consider this a heads-up.quot;

Thank you for the heads up. I was un-aware that this was illegal to distribute, I was certainly not selling it for profit. For this reason I have ended the item. But I am still confused as to how someone like APC or any other PC mag can distribute shareware on their CDs?? Please get back to me...

After reading the post you put on the websites, and reading the
replies, I have a something to say, coz I can't reply for another 2-5
days after signing up.

I wasn't trying to make a buck... I'm on dial-up and I know how
frustrating it is when your trying to download something, especially
large files. And I know that I would have paid for these items rather
than spending a week downloading them. I used to live in the country
where my internet connection would drop out every 20 minutes, at least
now in the city it's not so bad.

I have removed these items from eBay because I was not trying to rip
anyone off, all I wanted to do was provide a service and increase my
eBay reputation. But it seems for most people it was decreasing my
reputation.

I have also donated $20US to the DVD Decryter creator/developer also
explaining why I had decided to donate the money. This $20US is more
than I received for the 2 CDs that were purchaced off me.

I think the software on the CD is great and I would not like to rip
off the creator, they are providing an excellent service to all of
us...

Just had to get that off my chest...

Cheers
Sounds like he is just incredibly stupid.

Let me make you a simple question.

Is there anybody buying this kind of stuff?

Ok, it can be the same as those cd/dvd that come with certain computer mags, you pay for the mag and the cd/dvd are (free?); but pay for sth you can get for free in the internet (I'm not talking about p2p), it's meaningless.
Most of the ppl with a little basis in computer/internet will realize this is a holly shit, but I know plenty of ppl that would buy it.

Am I wrong or am I right? Not too long ago, did another f000k*** person made a cd of several software (share, free or demo -ware) and some guides (assuming he had made them when their source was ) ?

[EDIT]Shipping outside Australia isn't included, and even worse he dontated $20 to DVD Decrypter dev. this man is as stupid as a monkey. If I did that I would donate a part of each cd sold (at least).
That reminds me other time, when in my country not everyone had a cd-burner, only a few privileged had one so they made a good fortune of us. Time passes too fast

you bet your assets there is.

have a read of the extremely long quot;Stickyeople ripping people (2nd Round): DVDx versus DVDBackupquot; thread some time. i know i mention somewhere in there about how in an interview the head(of now dead) 321studios said they had sold something like over 200,000 copies of dvdcopyplus towards the end of 2002 and were still selling it righ to the end. at $49:95(U.S. dollars) a go i am sure you can see how they made it so big.
dvdcopyplus was of course a bunch of freeware bundled with a guide(which is what they claimed you bought and not the programs).
