The answer is there, but it is long in deciding overly..

when it's done... the ateme AVC codec is still in beta stage.

Let's rather say that we still are trying to improve it ( and h264 is complicated enough for such a process not to have a end ). x264 is still been working on, yet I wouldn't call it beta. So it is for Ateme's codec.when the new nero digital with the flashing new ATEME codec ?

When it's done. Meanwhile, unless you need to encode interlaced content or need strict cbr constraints, x264 is quite up to the task.
